When you enter into an agreement with us to provide products or services, you agree to the following terms and conditions. There are general terms and conditions and more specific terms and conditions for specific products and services. All terms and conditions are applicable in all cases.

General Terms and Conditions
Contract Basics
By placing an order with Web 5 or requesting work from Web 5 you are entering into a contract that is legally binding and enforceable. By placing an order or requesting work, you agree to the following terms and conditions. Please read them carefully and only proceed with a purchase when you are happy to agree to these terms and conditions.
All agreements for products and services described on this website are made between you (the client) and Web 5 of 1 Portland Terrace, Harvey Road, Guildford, Surrey. GU1 3LT. Please use the contact details on the ‘contact us’ page to get in touch.
There are specific terms and conditions that apply to each product or service – please read the section appropriate to your purchase for specific terms and conditions.
These terms and conditions are governed and construed in accordance with English Law. If any part of these terms and conditions is found to be invalid or unenforceable, then the remainder of these terms and conditions will not be affected but will remain valid and enforceable.
Products and Services
When you purchase a product or service from Web 5 you are entering into a legally binding contract in accordance with the terms and conditions laid out in this document. The contract shall be deemed to have been made either at the point a purchase is made, or at the point a price has been agreed for services offered. Written confirmation by email or submission of a purchase order is required for approval of quoted services or products.
We try to list and offer enough detail of our products and services to ensure you know what to expect when making a purchase from us. From time to time our products and services may vary – please check detail of the product or service you’re ordering as Web 5 cannot take responsibility for products or services ordered in error.
All services offered are supplied in good faith and in accordance with ‘best efforts’ to give you what you want. Web 5 will not be liable for any service that you deem to be substandard for whatever reason.
Prices, Payment and VAT
Web 5 prices are clearly stated at the point of purchase or within a quotation for products and services. Whilst we make every effort to keep our prices up to date, on occasion there may be a disparity between the published price and our actual price – in these cases Web 5 reserve the right to charge the higher of the two prices. Any work that is undertaken for an agreed price must be actioned and completed within 3 months – If there are delays caused by the client, the price of the work done may be increased in line with the latest and current rates.
All products and services are payable in advance or at the point of ordering. Payment can be made through our payment gateway or via BACS (details will be supplied upon ordering). On occasion, for larger projects, we may allow a deposit and part-payments to be made before and during work being carried out. In these circumstances, the final payment at the end of the project is due within 7 days of the invoice date.
Prices do not include VAT and we do not currently charge VAT.
Cancellations and Refunds
Once a product or service is ordered it cannot be cancelled or the money refunded. All domain names, hosting packages and support contracts are for annual services which, once purchased cannot be refunded.
Liability
Web 5 is not liable for any frustration of this contract caused by strikes, labour disputes, accidents, extreme weather, power outage, connectivity issues, supplier issues or any other cause beyond Web 5’s control and outside the ordinary and reasonable contemplation of the parties at the time of the contract. In such an event, Web 5 shall use reasonable endeavours to offer the client alternative products or services, if such can be found and are acceptable to the client (such acceptance not to be unreasonably withheld). In the event that this is not possible, however, Web 5’s obligation to the client extends up to, and is limited to, the full refund of any deposits held.
Web 5 reserves the right to pass on to the client any additional costs incurred by them in respect of goods and services requested during the course of the work performed or caused by the client not adhering to the agreed terms of the services. (e.g. not supplying the relevant information to complete a website)
Web 5 Reputation
At the absolute and unfettered discretion of Web 5, any product or service may be cancelled, even if paid in full, if Web 5 has reasonable grounds for believing that by completing the work or continuing to provide the service would prejudice the reputation, good name, or standing of the business. Should Web 5 cancel any product or service it may, at its discretion, refund any advance payment made but will have no further liability to the client.
Client Responsibilities
If the website is managed by the client, the client assumes full responsibility for their website at the point they are given access to it. Web 5 reserve the right to cancel any and all services if the site is used for anything immoral, inappropriate, illegal or is false or misleading. We reserve the right to remove your website from our hosting and terminate our contract with you. No refund will be offered.
Privacy Policy
In accordance with The General Data Protection Regulations (GDPR) of 2018, Web 5 are committed to protecting your privacy and promise to collect, process and share your data safely and securely when you do business with us.

Transparency – We will always tell you what data we’re collecting about you and how we use it. We only share your data with third parties when it is necessary in the planning and deployment of your event. We never sell on your data.

Social Media and Marketing
As part of our marketing, from time to time we use our client’s websites as examples to show new customers what we can do. We respectfully request to use images, information and links to your website for social media and marketing purposes. This may include on our website, email marketing, news items and on social media. If you do not wish us to use your site, please let us know.
